Protecting consumer privacy is very important to Hatch Early Learning. Our Online Privacy Statement is designed to inform you about our online collection and use of personal information. From time to time, Hatch may modify this Online Privacy Statement.

We Use Appropriate Security Safeguards. At Hatch, security is a priority. Hatch employs appropriate measures, including advanced technology, to protect personal information collected online against unauthorized access, disclosure, alteration or destruction. These may include, among others: encryption, physical access security and other appropriate technologies. Hatch continually reviews and enhances its security systems, as necessary. When you browse the Hatch website, you do so without revealing your identity. This web site uses cookies only to aggregate information about the pages that users visit so that we can update and redesign, as necessary, our website in order to provide you with the most useful information. Personal information, such as your email address, is not collected, unless you provide it to us. Hatch does not disclose domain name or aggregate information to third parties other than vendors who assist us with our website and who are under strict confidentiality requirements.

At Hatch, we value your trust. We want you to know how we collect, use, share and protect information about you.

What Information is Collected?

We collect information from you when you register on our site, place an order, subscribe to our newsletter, respond to a survey or fill out a form, and use a social media service (for example, Hatch's Facebook, Twitter, LinkedIn, YouTube or Instagram pages).

When ordering or registering on our site, as appropriate, you may be asked to enter your name, e-mail address, mailing address, phone number or credit card information. You may, however, visit our site anonymously.

Google, as a third-party vendor, uses cookies to serve ads on your site. Google's use of the DART cookie enables it to serve ads to users, based on their visit to our sites and other sites on the Internet.

Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

Information Collected Through Cookies and Similar Technologies:

Hatch Cookies: We and our service providers use cookies, web beacons and other technologies to receive and store certain types of information whenever you interact with our website through your computer or mobile device. This information, which includes the pages you visit on our site, which web address you came from, the type of browser/device/hardware you are using, purchase information and checkout process, search terms and IP-based geographic location, helps us customize your website experience and make our marketing messages more relevant. This includes Hatch content presented on another website or mobile application. This information also allows us to provide features such as storage of items in your cart between visits. In order to provide the best guest experience possible, we also use this information for reporting and analysis purposes, such as how you are shopping our website, performance of our marketing efforts, and your response to those marketing efforts.

Third-Party Cookies:

We allow third-party companies to collect certain information when you visit our website and to use that information to serve ads for Hatch products, services or for the products or services of other companies when you visit this website or other websites. These companies use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over, hardware/software information, MAC address, cookie and session ID, and IP address) during your visits to this and other websites in order to provide advertisements about goods and services likely to be of greater interest to you. These parties typically use a cookie or a third-party web beacon to collect this information. User Experience Information:

In order to improve guest online shopping experience, help with fraud identification and to assist our guest relations representatives in resolving issues guests may experience in completing online purchases, we use tools to monitor certain user experience information. This includes login information, IP address, data regarding pages visited and ads clicked specific actions taken on pages visited (e.g. information entered during checkout process) and browser information.

Information from Other Sources:

We obtain information from companies that can enhance our existing guest information to improve the accuracy and add to the information we have about our guests (for example, adding address information). This improves our ability to contact you and improve the relevancy of our marketing by providing better product recommendations or special offers that we think will interest you.

Public Forums:

Any information you submit in a public forum (e.g. a blog, chat room, interaction with our chat bot or social network) can be read, collected or used by us and other, and could be used to personalize your experience. You are responsible for the information you choose to submit in these instances.

How is this Information Used?

Examples of how we use the information we collect from and about you include:

  • Product and Service Fulfillment:
    Fulfill and manage purchases, orders, payments, returns/exchanges or requests for information, or to otherwise serve you, provide services, such as Gift Registry or Wish List and administer sweepstakes and contests.
  • Our Marketing Purposes:
    Deliver coupons, newsletters, e-mails, mobile messages, end marketing communications and other information regarding products, services and promotions, administer promotions and use for content on our website (example: customer testimonials, such as quotes around satisfaction of products and experiences with Hatch).
  • Internal Operations:
    Improve the effectiveness of our website, stores, mobile experience and marketing efforts. We also conduct research and analysis, including focus groups and surveys. This information would be used to perform other business activities as needed, or as described elsewhere in this policy.
  • Fraud Prevention:
    To prevent fraudulent transactions, we monitor against theft and otherwise protect our guests and our business.

How is this Information Shared?

We do NOT sell, trade or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies or protect ours or other rights, property or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising or other uses.

How is Your Personal Information Protected?

  • Security Methods:
    We maintain administrative, technical and physical safeguards to protect your personal information. This includes encrypting your credit and debit card number. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers.
  • E-mail Security:
    "Phishing" is a scam designed to steal your personal information. If you receive an e-mail that looks like it is from us asking you for your personal information, do not respond. We will never request your password, username, credit card information or other personal information through e-mail.
  • Safe Shopping Guarantee:
    Our security measures are designed to prevent anyone from stealing and using your credit card number. Under the Fair Credit Billing Act, if your credit card is used without your authorization, your liability for those fraudulent charges cannot exceed $50. If your credit card provider does hold you liable for any part of this $50, we will cover this liability for you, provided the unauthorized use of your credit card resulted through no fault of your own from purchases made in our stores or at our website while using the secure server.
  • Children's Personal Information:
    We recognize the importance of protecting privacy where children are involved, and we are committed to protecting all children's privacy. We do not knowingly collect personally identifiable information online from children under the age of 13. If a child under the age of 13 has provided us with personally identifiable information online, we ask that a parent or guardian to contact us or call 800-624-7968.

What Choices Do You Have?

  • Postal Mail:
    If you do not wish to receive catalogs, coupons, and other promotional mail, contact us or call 800.624.7968 to opt out.
  • Telephone:
    If you do not wish to receive promotional telephone calls, contact us or call 800-624-7968 to opt out. This opt out does not apply to operational phone calls (for example, confirmation of delivery address).
  • E-mail:
    If you do not wish to receive promotional e-mails from us, contact us or call 800-624-7968 to opt out. You can discontinue store or catalog e-mails by canceling your subscription to these services. You also can unsubscribe to promotional e-mails via the opt out link included in each promotional e-mail.

California Online Privacy Protection Act Compliance:

Because we value your privacy, we have taken the necessary precautions to follow the California Online Privacy Protection Act. Therefore, we will not distribute your personal information to outside parties without your consent.

As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at any time by logging into their control panel and going to the 'My Account' page.

Shipping and Purchasing

Disclaimer

Manufacturers continually change product specifications. While we try our best to keep product descriptions up to date, they may not necessarily reflect updates from the manufacturer. We are not responsible for incorrect or outdated product descriptions and/or images. Due to possible typographical errors and fluctuations from manufacturers in our industry, prices may change without notice. Some items may contain small parts unsuitable for children 3 years of age or under.

Bids, Contracts, & Quotes

We welcome your request for bids and quotes on any of the products or services we provide. We can also accommodate yearly contracts for any institution or governmental agency upon request. Call our Bid Department for details at 800.624.7968. 

Tax Exempt

When paying with a Personal Credit Card or shipping to a personal address, sales tax will be applied to the invoice. Only purchases paid for and shipping directly to a tax-exempt organization will qualify for sales tax exception. Your invoice will include sales tax if we do not receive the exemption form prior to invoicing. You can enter your State Tax Exempt Code during the payment process. Tax exemption forms must be faxed to 800.563.9001. Please write the order reference number found at the end of the checkout process at the top of the form. Promotional Offer Exclusions

Offer cannot be combined with any other promotions, coupons or program discounts and may not be applied to previous purchases or outstanding purchase orders. Does NOT include truck/freight shipped items.

When Your Shipment Arrives

Before you sign the delivery receipt, inspect your shipment for any possible damage or shortages. If your FedEx Ground arrives damaged, call Hatch immediately at 800.624.7968 and we will coordinate the return and/or replacement of the merchandise. If your Truck shipment arrives damaged, write a note on the delivery receipt describing the damage. Please keep all cartons and packing materials along with your damaged merchandise together and call Hatch® at 800.624.7968.

Warranty

The Ignite by HatchTM product line, The iStartSmart® tablets and computers, WePlaySmart® multi-touch tables and TeachSmart® Learning System components are covered under warranty. The warranty for all other items will follow Manufacturer's Warranty. Call our Customer Service department for specific product warranty information at 800.624.7968 option 4.

Hatch Educational Materials Warranty Coverage

If you have purchased an education material item and you are not satisfied with your purchase after 30 days, please contact Hatch. We can assist you with a warranty claim under the manufacturer's published warranty if available.

Hatch Technology Warranty Coverage

All Hatch technology sold by Hatch and HatchEarlyLearning.com is supported by our Hatch Support Team and our preferred vendors. In the unlikely event there is a defect, please contact Hatch Customer Service to have it serviced under warranty or hear about out of warranty options. Return Policy

Hatch Early Learning values its relationship with our customers and offers returns for most items within 30 days of shipment. You may return eligible products for a credit or a refund of the purchase price paid, less shipping and handling and any applicable restocking fees, as set forth in detail below.

Requirements for a Full Refund/Credit

  • Items must be returned within 30 days of purchase
  • Return Authorizations (RA) are required for returning any items click here to submit RA request or call our customer support line 800.624.7968 option 4. Any product returned without prior authorization from Hatch will be considered an unauthorized return, and the customer will not receive credit for the product.
  • Items returned must be in new condition, with original packaging and accessories
  • Media items (movies, music, video games, and software) must be unopened and still in their plastic wrap
  • Costumes and other fabric items must be clean and unworn
  • If a return is sent to Hatch and does not arrive and you do not use a trackable method for the return, Hatch will not be able to credit the return to your account
  • All returned items are subject to a one-time restocking fee of 15% and return shipping cost
  • Note: Before you return any technology product to Hatch, make sure to back-up any data on the hard drive(s) and on any other storage device in the product. Remove any and all confidential, proprietary, and personal information as well as removable media such as flash drives, CDs, and PC Cards. Hatch is not responsible for any confidential, proprietary, or personal information; lost or corrupted data; or damaged or lost removable media that may be included with your return.

Promotional Items

If you return a purchased item that qualified you for a discount, promotional item or promotional card (e.g. buy a computer, get a free printer; buy technology, get a promotional gift card) and either (i) do not also return the discounted or promotional item or (ii) have already redeemed the promotional card, Hatch will deduct the value of the discount, promotional item or redeemed card from any refund you receive for the return of the purchased item.

Restocking Fees

Unless the product is defective or the return is a direct result of a Hatch error, Hatch will charge a restocking fee of 15% of the purchase price paid.

Items with FREE Return Shipping

The following product returns have Return Shipping included:

  • Technology that requires repair or replacement during warranty period
  • Defective or damaged products if vendor requires return under warranty

Hatch provides lifetime, toll-free technical support for as long as customers have our Computer Learning Centers operating in the classroom. Hatch Technology Solutions Privacy Policy

We at Hatch Inc. know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the software and services provided by Hatch, including Ignite® by Hatch and other applications (each a “Product,” collectively the “Products”), you acknowledge that you understand the practices and policies outlined in this Privacy Policy, and you hereby consent to our collection, use, and sharing your information in the following ways.

  1. What does this Privacy Policy cover?

    This Privacy Policy covers our treatment of information ("Collected Information") that we gather when you access or use our Products, but not to the practices of companies we don't own or control, or people that we don’t manage. We gather various types of Collected Information from our users, as explained in more detail below, and we use this Collected Information internally in connection with our Products in several ways, including: (i) delivering, improving and customizing our Products to fit your expectations and preferences; (ii) allowing you to set up User accounts and profiles; (iii) complying with various legal and regulatory requirements; (iv) contacting you and, when necessary, allowing other users to contact you; (v) fulfilling your requests for certain products and Products; and (vi) analyzing how you use the Products.

    Hatch is committed to protecting al Collected Information. We have adopted robust technical, administrative, and physical procedures to help protect this information from loss, misuse, and alteration. Hatch relies upon selected employees and business partners to properly develop, maintain, and operate our systems, networks, and processes which keep our sensitive information safe and properly used. All individuals and third party organizations handling our information are responsible the for keeping Collected Information safe, no matter where the information is stored, whether in computing systems, networks, paper copies, business processes, and verbal transmissions.

    We're constantly trying to improve our Products, so we may need to change this Privacy Policy from time to time. Material changes will be conspicuously posted in our Products or otherwise communicated to you. If you continue to use our Products after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

    Use of information we collect is subject to the Privacy Policy in effect at the time such information is used.

  2. What Information does Hatch Inc. collect?

    In order to use our Products, customers must create an account for themselves and for any of their employees, staff, students, children and parents (each a “User”) that interacts with the Products. In connection with these accounts, Hatch collects some Personally Identifiable Information (“PII”) for each User. The kinds of PII we collect varies based on the kind of User, as described below:

    (a) Customer or Subscriber Information. first name, last name, email address, phone number, and billing and payment information.

    (b) Child and/or Student Information. first name, last name, date of birth, gender, ethnicity, disability (limited to Individualized Education Plan (“IEP”) and/or Individualized Family Service Plan (“IFSP”), if applicable), picture, student identification number, and corresponding Teacher and Parent information associated with each child.

    (c) Parent/Guardian Information. first name, last name, child’s name and relationship to Parent/Guardian; email address and/or phone number.

    (d) Employee, Staff and/or Teacher Information. first name, last name, email address and/or phone number, teacher identification number, organization identification number, and site location.

    (e) Administrator Information. first name, last name, email address and/or phone number, and site location.

    Please note that depending on how you interact with the Product, you may fall under one or more different categories (for example, if you are both a Customer and a Parent). Your PII may be entered by you directly, or, alternatively, by another User – such as teacher or administrator – in order to grant you access to the Product, or to provide you with notices regarding the Product. If you are entering PII on behalf of a User other than yourself, you are responsible for obtaining the User’s express written consent.

    We may use your PII to communicate with you. For example, we may use your email address to send you promotional email offers or email you about your use of the Products. Also, we may receive a confirmation when you open an email from us. This confirmation helps us improve our communications and Products. You may stop receiving communications from us by choosing the "unsubscribe" option at the bottom of our emails.

  3. Information Collected and Sent Automatically.

    Your browser or device automatically sends us Collected Information whenever you interact with our Products. Collected Information we receive may include as your IP address, device identification, cookie information, the type of browser and/or device you're using to access our Products, and the page or feature you requested. "Cookies" are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how frequently Users visit the pages and features in our Products.

    We may use this data to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve our Products - for example, this data can tell us how often users use a particular feature of the Products, and we can use that knowledge to further innovate and advance our Products.

    Some browsers or devices may allow you to submit “Do Not Track” requests.” DUE TO THE AUTOMATIC COLLECTION OF DATA USING COOKIES, WE DO NOT HONOR "DO NOT TRACK" REQUESTS.

  4. Will Hatch Inc. Share Any of the Personal Information it Receives?

    We do not rent or sell your PII in personally identifiable form to anyone, provided that certain PII may be transferred to third parties in connection with business transfers, as described below:

    (a) Business Partner. In certain situations, and with customer's written consent we do share some child information (first name, last name, organization name) to our partner Teaching Strategy in order to aid our customers with children assessment process.

    (b) Protection of Company and Others. We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with laws, regulations, and/or court orders; or to protect the rights, property, or safety of Company, our employees, our users, or others.

    (c) Amazon Web Services. Currently, Hatch uses Amazon Web Services, Inc. (“AWS”) as a third-party service provider for data hosting. AWS has its own (c) policies and procedures for handling and protecting data, which may be reviewed at https://aws.amazon.com/legal/?nc1=f_cc, the terms of which are incorporated by reference herein.

  5. Is My Personal Information secure?

    Your account is protected by a password and/or other login credentials for your privacy and security. You are responsible for preventing unauthorized access to your account and Personal Information by selecting and protecting your password appropriately.

    We endeavor to protect the privacy of your account, PII, and other Collected Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of Collected Information and PII. We monitor our Products for unauthorized entry or use, and will pursue all legal remedies, whether civil or criminal, against unauthorized users. Unless otherwise stated, Hatch follows the following security guidelines:

    (a) General Procedures

    • All PII and Collected Information is stored in encrypted format on secured servers.
    • Key data, such as passwords, is encrypted inside all databases and servers to prevent access to sensitive data from internal users with raw data access.
    • Security software is updated to maintain current patches, updates, and credentials supplied by software vendors.
    • All login credential and validation is managed by AWS’s Cognito.
    • Hatch limits access to servers’ instances in several ways:
      • All servers are maintained on are on a private virtual network with no external IP addresses.
      • Access to production servers is limited only from a few terminals equipped with industry standard anti-virus software and protected by SOC2 Type II compliant firewalls.
      • A small team of Hatch employees necessary to provide and maintain our services are granted access to production servers. All such Hatch employees with access to servers must receive data privacy and security training and agreed to honor Hatch’s data protection policies as part of their employment contracts.
      • Access to servers is subject to strictly enforced, multi-factor access control.
      • Internal and external communication processes are well defined and strictly followed by the operations teams.
    • If requested to edit or update any PII or if a Support or Service ticket is generated based on technical issues only select Hatch authorized personnel will triage and work on the request.

    (b) Product Specific Procedures

    i. Ignite by Hatch

    • All communications to and from Hatch via Ignite are managed by Secure Sockets Layer (SSL) protocol, an industry-standard security protocol used for encrypting data.
    • Ignite by Hatch uses file system-level encryption services to ensure specific data files on all end-user device are encrypted and safe from improper access.
    ii. Hatch Insights
    • Hatch Insights store any PII only on secured servers.
    • All connections, queries, and other operations in Hatch Insights are managed by security-based Access Control Lists (ACLs). Key data, including logins as passwords, is encrypted inside the database to prevent access to sensitive data from internal users with raw data access.
    • Hatch Insights uses account-based content delivery to ensure that an organization’s data is only viewed by authorized users.
    • Hatch Insights data is hosted on a third-party server that has received global security certification and compliance verification for Service Organization Control levels SOC 2 Type II.

     

  6. What Personal Information can I access?

    Depending on your role, you have permission to add or edit details. Through your account settings, you may access, and, in some cases, edit or delete the information you’ve provided to us, such as First Name, Last Name, password, and contact information. The information you can view, update, and delete may change as the Products change. You have the right to request information about the PII we collect and use as set forth in Sections 7 and 8, below.

  7. Special notices and rights for Parents and Guardians under the Children’s Online Privacy Protection Act (“COPPA”).

    (a) Notice.COPPA is a federal law (15 U.S.C. §6501 et seq.) that gives parents and guardians special rights, including the right to notice about how we collect and use PII. We collect information on parents/guardians from Users such as the educational employees, staff, teachers and administrators in order to provide you with notice and obtain your consent relating to the collection of your child’s PII. The kinds of PII we collect is set forth in Section 2 above.

    (b) Consent . We cannot collect or use PII related to you or your child without your consent. From time to time, we may send you notices about changes in our collection and/or use of PII via pop-ups or notices in our Products, email, text message, or US Mail. Such notices may request your consent to our collection of PII. If you agree and consent, you are authorizing Hatch to collect and use your PII and your child’s PII in accordance with the terms of this Privacy Policy. If you do not consent to our collection of PII, or if you fail to respond to our notice within a reasonable time, we will delete the PII related to you or your child. Please be advised that refusing the collection of PII may make it impossible for Hatch to deliver the Products to you and/or your child.

    (c) Review of PII. You have the right to review any PII we collect related to you or your Child, email your request to us, and we will work with you to deliver a report on the PII in a reviewable format.

    (d) Retention and Deletion of PII. You have the right at any time to request the deletion of PII and/or refuse the further collection of PII from you or your child. Email your request to us, and we will honor your request. We may need to retain some of the PII for a short time in order to fulfill our obligations to you under an existing subscription or order, or under applicable laws. We will use commercially reasonable measures to protect your PII against unauthorized access and use until it is deleted.

  8. Your California Privacy Rights.


    (a) Notice. 
    California residents have specific rights under the California Consumer Privacy Act of 2018 (California Civil Code §§1798.100 et seq.) and other related statutes. In particular, Hatch collects PII in accordance with the purposes set forth in Section 1, and the categories of PII in the manner and ways set forth in Section 2. We do not sell or share any PII with any third party other than AWS as set forth in Section 5, above.

    (b) Review of PII. You have the right to review any PII we collect related to you or your Child. Email your request to us, and we will work with you to deliver a report on the PII in a reviewable format within 45 days of your request.

    (c) Retention and Deletion of PII. You have the right at any time to request the deletion of PII, or to refuse the further collection of PII from you or your child. Submit your request to us via email, US Mail at the address provided below, by online form on our website, or, if possible, through links provided in the Products. We may need to retain some of the PII for a short time in order to fulfill our obligations to you under an existing subscription or order, or under applicable laws. We will use commercially reasonable measures to protect your PII against unauthorized access and use until it is deleted.

  9. What choices do I have?

    You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to use some of our features for your benefit.

    You may be able to add, update, or delete your PII as explained above. When you update information, however, we may maintain a copy of the unrevised Collected Info and/or PII in our records.

    You may contact us to request deletion of your account using the contact information below. Some Collected Information and PII may remain in our records after your deletion of such information from your account.

    We may use any aggregated data derived from or incorporating your PII after you update or delete it, but not in a manner that would identify you personally.
